PRIVACY POLICY

Your privacy is very important to us. Accordingly, we (“we” and “GovGig” mean Watermark Solutions, L.L.C. d/b/a GovGig, a Washington limited liability company), have developed this privacy policy (this “Policy” ) in order for you to understand how we collect, use, communicate and disclose personal information. This Policy explains data collection and use practices of the Govgig.com website and any sub-sites (the “Website” ); this Policy does not apply to the practices of other online or offline websites, products or services. By accessing the Website, you, the visitor, are consenting to the information collection and use practices described in this Policy. This Policy is part of Govgig’s Terms of Use.

1) Collection of Your Personal Information

We may collect certain information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access our Website; the pages that you access while at the Website and the Internet address of the website from which you linked directly to the Website. This usage information helps improve the Website, analyze trends, and administer the Website.

For all users of our website, we collect your email address and company, if relevant. Other information we collect is described below.

We provide several services to you. The primary service is assistance with federal government contracting. This assistance includes analysis of RFPs and breaking an RFP into parts such as specifications, bid requirements, etc. It also includes locating prime contractors who may wish to use you as a sub-contractor, sub-contractors you may wish to use if you are bidding as a prime, a way for persons to register as available and, similarly, a way for companies who are interested to engage a person’s services. This Privacy Policy covers all of the above and any additional services we may choose to provide.

2) Use of Your Personal Information

Use for the Services. The personal information collected on this Website will be used to operate the Website and to provide our services or carry out the transactions you have requested or authorized. GovGig may hire other companies to provide services on our behalf (for example, our web hosting provider), and we may provide such companies with the personal information they need to perform their duties. If we do, they will be subject to requirements to keep any such information confidential and to only use such information to provide their services to us.

Improve Website Experience. GovGig may use personal information to provide you with more effective service, to improve the Website and our services, and to make the Website easier to use by eliminating the need for you to repeatedly enter the same information. In order to offer you a more consistent experience in your interactions with GovGig, information collected by the Website may be combined with information collected by GovGig from other sources

Legal Disclosure. GovGig may disclose personal information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on GovGig; (b) protect and defend the rights or property of GovGig or its affiliates; or (c) act in urgent circumstances to protect the personal safety of GovGig employees or agents, users of GovGig products or services, or members of the public.

Geographical Transfer. Personal information collected on the Website may be stored and processed in the United States or any country in which GovGig or its affiliates or agents maintain facilities, and by using the Website you consent to any such transfer of information to another country.

We will not sell your personally identifying information without your explicit opt-in consent. We may, however, sell Aggregated Anonymous Data relating to usage (some examples of such data are total number of users, number of winning bids in which Govgig’s services were used, etc. Please see the Terms of Use for more examples of how we use Aggregated Anonymous Data). We will transfer your data in instances that you specifically ask us or if the services we provided demand it. For example, if you have provided us a resume or applied for a posted job, we will share your resume with companies which may be interested in you or with the company to which you are applying.

3) Control of Your Personal Information

GovGig may send out periodic e-mails to you with information on our products or services. You will be given the option to unsubscribe from these mailings. In addition, we may request your permission to use your name or your company’s name in our marketing. We will only do so with your explicit consent to that use.

4) Data Security

GovGig will use commercially reasonable efforts to protect your personal information from unauthorized access, use, or disclosure. However, due to computer hackers, electronic malfunctions, and other events, GovGig cannot guarantee that such safeguards will always protect such information. Furthermore, we do not control what recipients of information you provide us do with your information.

5) Information Received from Cookies and Third Parties

Storing cookies. We may use cookies on this Website to enhance your user experience. A cookie is a small text file that is placed on your hard disk by a webpage server. One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you navigate within a website, a cookie helps the website to recall your specific information on subsequent visits. This simplifies the process of delivering relevant content, eases website navigation, and so on.

Browser Setting. You have the ability to accept or decline cookies. Most Internet browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the features of this or other websites you visit.

Partners. GovGig collects your information from third parties to facilitate activities and transactions for the operation of the Website and its services, to improve your Website user experiences, and to further Govgig's mission. Examples of such third parties are Google (using Google Analytics) or Amplitude (using their analytics tools).

We may use this information as a tool to compile anonymized and aggregated statistics about the Website usage, such as how many visitors clicked on key elements (such as links or graphics) on a webpage. We may share such Website statistics with partner companies.

We may also share your information in connection with proposed or actual financing, or activities related to a merger or acquisition of GovGig. This Privacy Policy will be binding on any successor to GovGig.

6) Use of Artificial Intelligence (AI)

GovGig uses AI to analyze RFPs from the federal government to better assist you with responding to an RFP. GovGig may also use AI to analyze and model bids submitted as response to RFPs, including any RFP responses. Generally, RFP responses are public information and subject to FOIA. However, if you specifically request that we not include a particular response of yours in our training data, we will honor your request.

In the future, we may also use AI to review and screen any resume you submit. This will include a general review as well as a screen for a posted job you have directly applied to through GovGig or to select resumes from our general applicant pool to provide to the job poster. Should we do so, we will provide additional disclosures relating to our use of AI and any rights you may have. We may also use your information to train our AI model, although we will anonymize it if we do.

7) Special Notice about Children and Minors

This Website and our services are meant for business related transactions, such as assistance with responding to federal RFPs, or providing contractors to a business responding to an RFP. If you are under the age of 18, do not use our Website.

8) Special notice for residents of certain states

Your rights. Depending on your location or state of residence, you may have the statutory right to request the following with regard to your information:

  • Access to, or a copy of, your information
  • Confirmation that we are processing your information
  • Correction or amendment of your information
  • Deletion of your information
  • Transfer of your information to a third party, where technically feasible
  • Restriction or objection to certain uses of your information

As provided in applicable law, you also have the right to not be discriminated against for exercising your rights. Where we process your information based on your consent, you may withdraw your consent at any time by contacting us as described in the "How to contact us" section below. We cannot provide you our services if you withdraw your consent to our processing.

Please note that under applicable law, certain information may be exempt from the requests above. For example, we may not be able to alter or delete certain information if we are required to retain it to fulfill our obligations to you, for security reasons, to comply with applicable law, for internal business purposes, or for other valid legal reasons.

We need to verify your identity before responding to a request, which will include confirming your email address. If we are unable to verify your identity, we may not be able to process your request. If you designate an authorized agent to submit requests on your behalf pursuant to applicable law, in order for us to verify the authorized agent, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may follow up with you to verify your identity before processing the authorized agent’s request. If you have a password protected account with us, we will verify your identify through that account. If you do not have a password-protected account with us, we will ask you to supply at least three pieces of personal information and sign a declaration under penalty of perjury that you are the consumer whose personal information is being requested. If you are requesting deletion of personal information, we will confirm for a final time that you would like to delete your personal information.

For further information regarding your legal rights or to exercise any of them, please email us at support@govgig.com and explain the type of request you want to make and the information about which you are making the request. You may also be able to exercise certain choices – like updating your information – through your account.

Depending on applicable law, you may have the right to appeal our decision to deny your request, if applicable. In such situations, if we deny your request, we will provide you with information on how to appeal the decision.

9) Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We encourage you to periodically review this Policy to stay informed about our practices. Your continued use of the Website after a Policy change constitutes your agreement to the revised Policy.
